Abstract
摘要：在环境司法中适用风险预防原则在各国已取得一定共识，但如何适用风险预防原则仍面临规范的法律确认不足和裁判的主观标准不一等问题。环境司法裁判适用风险预防原则的问题本质在于科学要素与法律要素的话语转换。印度环境司法的实践和查尔斯·韦斯框架提供了经验和启示。要实现风险预防原则在中国环境司法中的适用，须识别风险预防原则的适用领域，构建识别科学不确定性程度与司法证明程度、责任承担方式相对应的裁判指南。
