Abstract
-Examines a decision of March 13th, 2012 in respect of an appeal brought against Durham County Council's refusal of planning permission for an enabling development proposal, whereby the restoration of a Grade II listed mansion house would be funded from the profits of a housing development constructed on its estate, on the ground of the unsustainability of the housing.
-Assesses the correct test for determining enabling development proposals.
-Discusses the legal and policy issues raised by the case.
